As with other criminal matters, the burden of proving each and every element of the charged offense is on the government.  This means that the government must demonstrate facts as to each element of the offense proving, beyond a reasonable doubt, that element is met.  The government must also prove that the officer had probable cause for the stop that resulted in your arrest, that the officer properly administered each and every test he or she gave you, and that the equipment used by the officer to perform each test functioned properly at the time it was used by the officer.  In addition, there are factors that, if present in your particular case, may prove very helpful in reaching a positive resolution of your case.

DMV Hearing

The DMV hearing provides you with an opportunity to be heard prior to DMV taking administrative action against your driving privilege.  However, a hearing  will NOT be scheduled UNLESS you request the hearing within 10 calendar days of receipt of the "Notice of Suspension", issued by the officer at the time of your arrest.  If you do not request a hearing within the 10-day period, you will have lost the opportunity to show the DMV that the administrative suspension of your driving privilege is unjustified. 

The DMV hearing, regarding your driving privilege and the circumstance surrounding your arrest, is an administrative proceeding that is separate from the criminal court proceeding dealing with your criminal charge of driving under the influence.  The DMV hearing will not address the issue of whether the government can prove your guilt beyond a reasonable doubt, nor will it hear evidence pertaining to particular defenses which may be available in your criminal matter.  At the DMV hearing, only the following questions will be at issue: 

  • If you took a blood, breath or (if applicable a) urine test:
    • Did the officer have probable cause to stop you?
    • If so, was your arrest otherwise lawful?
    • Were you driving a motor vehicle when you had 0.08% or more by weight of alcohol in your blood?
  • If you refused to submit to or failed to complete a blood, breath or (if applicable a) urine test:
    • Did the officer have reasonable cause to stop you?
    • If so, was your arrest otherwise lawful?
    • Did the officer inform you that your refusal to submit to or failure to complete a blood, breath or (when applicable) urine test would result in the suspension of your driving privilege for one year or in the revocation of your license for two or three years?
    • Did you refuse to submit to or fail to complete a blood or breath or (when applicable) a urine test, after being requested to do so by a peace office?
